When Beccaria and the other legal reformers of the 1700's were arguing against the use of physical punishments?

I am just wondering if I am on the right track with my own version. I am just wondering what you guys think about judicial leniency. I have already wrote my answer, but I want some other feedback on the topic. Please let me know what you guys think of judicial leniency?
